Can I fight an eminent domain action?

The eminent domain process is a two step process. One is, can the government acquire the property. In order to fight that stage, we would investigate whether or not the government has complied with all the rules necessary, prior to them obtaining the land. And that would include, did they consider alternative alignments? Did they consider cost, environmental? And some other factors.

In addition, have they made a good faith estimate, based on a valid appraisal. If they have failed to do those things we can actually stop the taking. Most of the time, when we fight an eminent domain lawsuit. We are fighting about the value to paid, the full compensation to be paid and then also engineering changes. Fighting for larger driveways, smoother transitions. So, yes absolutely, we fight eminent domain lawsuits everyday. It’s what we do.
