How does the lawsuit work?

 

The government has the power eminent domain however, that doesn’t mean they can simply take your property. If they are unable to negotiate settlement with you prior to filing a lawsuit, they have to file a petition in the county where the property is located. Once they file the petition they have to show that there is a need for your property for a public purpose and that they have done a good faith estimate value based on a valid appraisal report. Once they do this and they file the petition, you become a defendant in an eminent domain lawsuit, and it’s your responsibility to answer the appropriate pleadings in a timely manner.
