Inverse condemnation is where the government has failed to follow the rules, of filing their lawsuit before they utilize your property. And by utilizing your property … I’ve had cases where retention bonds were actually built on private property, or where light poles were actually built on private property.

You do have a recourse, and that is you become the plaintiff, you file the government for a lawsuit against the government, and inverse condemnation. Once the judge declares the taking, then the case will proceed as a normal imminent demand case, where all your attorney’s fees and costs are paid for, and you’re entitled to be paid full compensation.
