Who pays for these experts?
Well, at Brent Simon Law Group, our firm requires that the condemning authority, which may be a government or a utility, pay for the experts utilized to help defend and present your case. The Florida Supreme Court long ago found that it’s not fair for a land owner to have to pay out of their own pocket to compete with the government when the government basically has an unlimited tax authority to hire all the experts that they want. Oftentimes you’ll see the condemning authority has an army of experts. In order to meet them on an equal basis, the government is required to pay your attorney’s fees, your expert costs, whatever is reasonable and necessary.
Some firms want to charge you, but our firm does not. Our firm is established and we can wait till the case is over and have the condemning authority pay the fees and costs to represent you. You pay nothing.
